Donald Trump has become the first US President to be sentenced as a felon after his conviction in a hush money case was upheld by a US court. The charges against him, involving the cover-up of unaccounted payments to adult film star Stormy Daniels, resulted in an “unconditional discharge.” Due to his election as President of the United States, Trump will not face jail time or financial penalties, as his upcoming presidency grants him immunity while in office.

The sentencing, delivered by New York judge Juan Merchan, highlighted the constraints of the legal system when dealing with a sitting President. Despite the severity of the 34 counts of falsifying business records, which could have warranted a four-year prison term, the constitutional protections afforded to the office of the President necessitated the unconditional discharge.

Judge Merchan expressed that the circumstances were unprecedented, stating, “Never before has this court been presented with such a unique and remarkable set of circumstances.” It was further acknowledged that any alternative sentencing would have risked encroaching on the immunity provided to the highest office in the United States.

Trump did not appear in person at the sentencing, instead opting to participate virtually, fully aware that his presidential status would preclude any possibility of incarceration. The court’s ruling came just ten days before Trump is set to be inaugurated for a second term as President, a situation that has stirred significant debate about legal accountability and executive privilege.

Prior to the sentencing, Trump had mounted an extensive effort to avoid conviction, asserting that the proceedings were intended to harm his reputation and impact his electoral prospects. Despite his claims of victimisation, the testimony of witnesses during the trial solidified the evidence against him, confirming his involvement in the fraudulent cover-up of payments to Stormy Daniels.

The case proceeded after a ruling from the US Supreme Court allowed the sentencing to move forward, dealing a significant blow to Trump’s legal manoeuvres. As he prepares to return to the White House, the implications of this historic sentencing continue to resonate across the nation.
